Recovery of Fees Paid Above the Ceiling for Doctors, Teachers and Self-Employed Workers

Many professionals, including doctors, teachers, and self-employed individuals in the private sector with more than one employment status, may be contributing to the INSS (National Institute of Social Security) beyond the established limit, resulting in undue payments. Normative Instruction No. 971 of 2009 and Ordinance No. 2 of 2024 establish a maximum limit for INSS contributions of R$7,786.02. Any amount paid beyond this limit may be refunded.

Legal Basis:
According to tax and social security legislation, in particular Normative Instruction No. 971/09 (Art. 87, § 2, item I, item "b") and Ordinance No. 2 of 2024 of the Federal Revenue Service, INSS contributions must comply with the social security limit of R$7,786.02. Any excess paid in error must be recovered upon request.
